These Terms and Conditions ("Terms") govern your use of the website located at chicodeckandfence.com and your engagement with the services provided by Precision Chico Deck & Fence ("we," "us," or "our"). By using our website or engaging our services, you agree to these Terms. Please read them carefully.
By accessing our website or requesting an estimate or service, you confirm that you are at least 18 years old and have the legal authority to enter into a binding agreement. If you do not agree to these Terms, do not use our website or services.
Precision Chico Deck & Fence provides residential and commercial deck construction, fence installation, pergola installation, patio covers, and related outdoor structure services in Chico, CA and surrounding communities.
All services are subject to the terms of a written contract or proposal signed by both parties. Information on our website is for general informational purposes only and does not constitute a binding offer or guarantee of availability, pricing, or timeline.
Estimates provided by Precision Chico Deck & Fence are based on information available at the time of the site visit and are valid for 30 days from the date issued unless otherwise stated in writing. Estimates are not binding until a written contract is signed by both parties.
Final pricing may change if site conditions, material costs, or the scope of work changes after the estimate is issued. Any changes to scope or price will be presented as a written change order before additional work begins. We will not proceed with work beyond the original scope without your written approval.
Price ranges shown on our website or in marketing materials are general ranges only and are not a quote for your specific project. Contact us directly for an accurate estimate based on your property and project requirements.
Project start dates are estimates based on our current schedule and are not guaranteed. We will make reasonable efforts to begin work on or near the agreed date, but delays may occur due to weather, permit processing times, material availability, or other factors beyond our control.
If you need to cancel a signed contract, please notify us in writing as soon as possible. Cancellation terms, including any applicable fees for work already performed or materials already ordered, will be specified in your written contract.
We reserve the right to suspend or terminate work if site conditions become unsafe, access to the property is denied, or required payments are not made according to the agreed schedule.
Payment terms are specified in each written contract. In general, we require a deposit before work begins and final payment upon completion of the project. Specific deposit amounts and payment milestones will be outlined in your contract.
Accepted payment methods will be specified in your contract. Payments not received by the due date may result in a work stoppage and may be subject to late fees as described in your contract.
Under California law, contractors may not collect more than 10 percent of the contract price or $1,000 as a down payment, whichever is less, before the project begins. We comply with all applicable California contractor payment regulations.
Precision Chico Deck & Fence is responsible for obtaining all required building permits for work we perform, unless otherwise agreed in writing. You are responsible for ensuring that the property you own or control complies with any applicable homeowners association rules, deed restrictions, or local ordinances that may affect the project. You agree to provide accurate property information and reasonable access to the site for inspections and construction.
We stand behind our workmanship. Any specific warranty terms for labor or materials will be stated in your written contract. Unless explicitly stated in a written contract, we make no warranties, express or implied, regarding the suitability of any specific material for a particular purpose beyond its manufacturer's specifications.
Manufacturer warranties on materials such as composite decking boards, hardware, and fasteners are passed through to you and are subject to each manufacturer's terms. We will assist you in filing a valid warranty claim, but manufacturer decisions are outside our control.
To the fullest extent permitted by law, Precision Chico Deck & Fence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, including but not limited to loss of profit, loss of use, or property damage beyond the value of the contract.
Our total liability for any claim arising from our services shall not exceed the total amount paid by you under the applicable contract. Nothing in these Terms limits liability for personal injury caused by our negligence, or for any other liability that cannot be excluded under applicable law.
The content on our website is provided for general informational purposes only. We make reasonable efforts to keep information accurate, but we do not guarantee that all content is current, complete, or error-free. Images of completed projects are representative examples only and may not reflect the exact appearance of your finished project.
If a dispute arises between you and Precision Chico Deck & Fence related to our services, we encourage you to contact us first so we can attempt to resolve it directly. Most issues can be resolved through open communication.
If direct resolution is not possible, disputes will be resolved through binding arbitration in Chico, CA, under the rules of the American Arbitration Association, unless both parties agree in writing to a different process. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction to protect their interests while arbitration is pending.
These Terms are governed by and interpreted in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to the arbitration clause above shall be brought in the appropriate courts located in Butte County, California.
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Your continued use of our website after any changes constitutes your acceptance of the updated Terms.
